Session Description
It is not unusual for homeless individuals to establish refuge and shelter in encampments that encroach within, around, under, or upon transportation rights-of-way, including highway/freeway interchanges, overpasses, bridges, and tunnels. The responsibility of addressing such encroachments often involves transportation agencies at the state and local level. National Cooperative Highway Research Program Legal Research Digest Project 20-06/Topic25-04, Laws and State DOT Practices Related to Homeless Encampments in Transportation Rights-of-Way, which documents the laws, statutes, cases, procedures, policies, and other resources governing or addressing: (1) a transportation agency’s prevention and removal of homeless encampments from the transportation right-of-way and legal claims in opposition thereto; (2) the authorized use of the transportation right-of-way for homeless shelters along with social services to assist transportation agencies in addressing safety, health, and public welfare issues, and (3) the ability of transportation agencies to control their right-of-way will serve as a focal point of the panel’s discussion of this increasingly important subject.
