Recent developments and emerging issues in eminent domain law and property valuation including the SCOTUS Cedar Point Nursery case (mandating temporary, limited access for union organizers to talk to workers on private property a per se taking); use of Title VI of the Civil Rights Act of 1964 to challenge the right to take (project location); valuation of reversionary interests in roads, streets and highways; and severance of water rights resulting from takings, among others.
